Notes on use and brokerage

1. What this page covers – and what it does not

These notes apply to the use of this website and to the brokerage we build on it. They are not terms and conditions for a purchase or for construction work: the terms for a specific order are stated in the respective quotation and are attached to it. Reading this page does not conclude a contract.

2. Who we are

This website is operated by mkm International GmbH, Boschstr. 16, 47533 Kleve, Germany. It is the system supplier for the nano façade insulation made by PSCoat Zurynski, Özdogan & Co. GmbH, it refers projects to independent executing businesses, and it also sells the material itself if you only wish to buy material. The full details required by § 5 DDG are given in the legal notice.

3. Who your contractual partner will be

That depends on what you order, and it is stated on every quotation. If you have insulation installed, the contract is concluded between you and the executing business: it owes the work, it is liable for it, and its general terms and conditions for execution apply, which are attached to the quotation. mkm International GmbH is not a party to that contract.

If you buy the material only, the contract of sale is concluded between you and mkm International GmbH. Its terms of sale then apply, likewise attached to the quotation.

Advice, an on-site appointment and the brokerage itself do not create a contract and cost you nothing.

4. What sales agents may do

The sales agents responsible for you advise you and refer your project. They do not conclude contracts, give no binding price commitments and accept no payments. Only what your contractual partner confirms to you in text form is binding – in the quotation and in the order confirmation. If anyone tells you otherwise verbally, please ask for written confirmation.

5. Prices, calculator and product information

All information, prices and descriptions on this website are non-binding and serve as initial information; changes, errors and availability remain reserved. The price calculator provides an estimate based on your entries, not a quotation. A price becomes binding only in the quotation, after measurement and inspection of the substrate. This clause concerns the website only – a quotation you receive later is not rendered non- binding by it.

6. Advice, technology and funding

We advise to the best of our knowledge on the basis of the information you give us; we cannot vouch for its accuracy or completeness. Technical statements about the product come from PSCoat Zurynski, Özdogan & Co. GmbH as the manufacturer. Information on funding programmes explains the procedure and does not replace energy consultancy; whether and how much funding is granted is decided by the funding body. Guarantees expressly given remain unaffected; they follow from the quotation.

7. Liability

The respective contractual partner, not the broker, is liable for breaches of contract, defective performance or damage arising from a brokered contract.

Otherwise mkm International GmbH is liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under the Product Liability Act and to the extent of a guarantee given. In the case of simple negligence it is liable only for the breach of material contractual obligations – obligations whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely – and limited in amount to the foreseeable damage typical of the contract.

The contents of this website are protected by copyright. Reproduction or use in other electronic or printed publications is permitted only with express authorisation.

9. Data protection and final provisions

How we process personal data is set out in our privacy policy. German law applies. Should individual provisions of these notes be invalid, the validity of the remaining provisions is unaffected. Whether we take part in dispute resolution proceedings before a consumer arbitration board is stated in the legal notice.
